Check Duplicates 201: Indemnifications

This course provides a deep dive into remote deposit capture (RDC) indemnity as outlined in Regulation CC, focusing on indemnification claims between Depositary Banks. Learners will explore the legal framework governing RDC indemnity, the responsibilities of RDC and Paper Depositary Banks, and how indemnification claims are enforced in cases of losses due to duplicate presentment.

Through real-world scenarios and case studies, learners will gain insight into conditions under which an RDC Depositary Bank indemnifies a Paper Depositary Bank, the requirements for a Paper Depositary Bank to enforce an indemnity claim, how to determine the identity of the indemnifying bank when multiple Depositary Banks are involved, key indemnification scenarios, including complex situations where multiple RDC Depositary Banks exist, and strategies for mitigating indemnification losses, such as proper check indorsement practices.

By the end of this course, learners will be able to navigate RDC indemnification claims with confidence, apply key regulatory provisions effectively, and reduce financial risk associated with duplicate presentment.
